1. Acceptance and legal service

By using this store or placing an order, you agree to these terms. If you do not agree, do not use the store.

2. What this store is

Hexmonde is an online store operated by IG9Labs LLC. Some objects are designed and made by us; others are selected from other makers for everyday use. Each product page says who made it. We may change, suspend or discontinue any part of the store at any time without notice.

3. Orders

Who can order

To order, you must be at least the age of majority where you live.

Placing an order

An order you place is an offer to buy. It is accepted only when we ship it. Until then we may decline or cancel it, in whole or in part, for any lawful reason, including unavailability, a suspected fraudulent order, or an error in the price or description. If we cancel an order you have paid for, we refund it in full.

We try to describe and photograph every object accurately, but colors vary between screens and small variations are normal in made objects. A description is not a guarantee of exact appearance.

4. Prices and payment

Product prices are shown in United States dollars. Applicable sales tax and delivery are added at checkout. Prices may change at any time, but a change does not affect an order we have already accepted. If an object is listed at an obviously incorrect price, we may cancel the order and refund you rather than honor it.

5. Delivery, returns and refunds

This section is our shipping and returns policy. It also stands as the Shipping policy and Refund policy shown at checkout.

Delivery

We currently ship within the United States, including the U.S. destinations enabled at checkout. We do not currently offer international shipping. We pack and ship every order as soon as we can. Pre-order objects ship once our stock arrives (see Pre-orders below). If an order will take longer than expected, we email you.

Shipping is calculated at checkout. Standard shipping is free on orders of $125 or more. The free threshold applies to the merchandise subtotal after discounts. Delivery time depends on the destination and service; a ship date is not an arrival date. Carrier transit estimates are not guarantees. The shipping charge is shown separately before payment, and we add nothing afterward. You get a confirmation email when the order is placed and a second with tracking when it ships; if the tracking has not moved for several days, write to us and we will chase the carrier.

We send to the address given at checkout. If you spot a mistake, write to us at once and we will change it if the order has not left us; once it has shipped, it cannot be redirected. If a package is clearly lost, or arrives damaged, tell us within 7 days of delivery, with a video if you can, and we will replace it or refund you, and we handle the carrier claim ourselves.

Pre-orders

Some objects are sold before our stock arrives. They are marked Pre-order, with the date we expect them. You pay in full when you order, and your price is locked. We ship as soon as our stock arrives; if your order also has objects in stock, we ship those right away and the rest when it arrives, at no extra shipping cost. You can cancel a pre-order for a full refund within 7 days of ordering; after that, write to moi@hexmonde.com and we will do our best to help. If the date moves, we email you the new date, and you can wait or cancel for a full refund. If we cannot ship within 30 days of the date first shown, we cancel and refund you in full unless you tell us you would rather wait.

Returns and refunds

Unopened objects: you can return an object within 7 days of delivery if it has never been taken out of its packaging. Email moi@hexmonde.com with your order number first. You pay the return shipping, and we refund the price once it arrives.

Wrong or defective: if we sent the wrong object, or it arrives damaged or defective, tell us within 7 days of delivery, with a video if you can. We pay the return shipping and replace the object or refund you, whichever you prefer.

Wrong size (clothing): within 7 days of delivery, we exchange clothing for another size if it is unworn, with its tags and original packaging. You pay the postage back; we send the new size.

Art objects, such as wall art and desk art, are final sale unless they arrive damaged or wrong. Everything else is final sale. If a defect only shows up later, write to us and we will honor it as the law requires.

When a refund is due, we refund the original payment method within five business days of receiving the object; how long the money then takes to appear is up to your bank or card issuer. Nothing here limits any right you have under consumer law that cannot be limited.

Risk in an object passes to you on delivery. Title passes when we have received payment in full.

6. Intellectual property

The content of this store, including its text, photographs, designs, code, interface, and the Hexmonde name and marks, belongs to IG9Labs LLC or its licensors, including the makers whose photographs and product details we show. You may not copy, modify, distribute, reverse engineer or make derivative works from it without our written permission. Automated scraping of this store is not permitted.

Reporting infringement

If you believe something on this store infringes your copyright or other intellectual property, email legal@hexmonde.com with: the work you say is infringed; the page address (URL) where the material appears; your name, address, phone number and email; a statement that you believe in good faith the use is not authorized by the owner, its agent or the law; a statement that your notice is accurate and, under penalty of perjury, that you are the owner or authorized to act for the owner; and your physical or electronic signature. We review each notice and, where it is valid, remove the material.

Counter-notice

If material you provided was removed and you believe that was a mistake, send a counter-notice to the same address with: the material and where it appeared; a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification; your name, address and phone number; your consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any district in which IG9Labs LLC may be found); and your physical or electronic signature.

7. Acceptable use

You agree not to use bots, scripts or automated tools against this store, not to attempt to exploit or interfere with it, and not to do anything that disrupts it for other people. We may end your access for a breach of this section.

8. Disclaimers

The store is provided as is and as available. To the fullest extent the law allows, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We do not warrant that the store will be uninterrupted or error free. Nothing here excludes any right you have under consumer law that cannot be excluded.

9. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue or data, however caused. Our total liability arising out of or relating to an order is limited to the amount you paid for that order.

10. Accessibility

We aim to meet WCAG 2.2 Level AA and to keep this store usable with assistive technology. How we check, and where we fall short, is set out on our Accessibility page. Full compatibility with every tool and configuration is not guaranteed.

If you meet a barrier, please tell us at legal@hexmonde.com so we can fix it; we reply as soon as we can. Nothing in these terms limits any right you have under disability law.

11. Governing law

These terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Sacramento County, California, and you consent to their jurisdiction.

12. Changes

We may update these terms. The date at the top tells you when they last changed. The version in force when you place an order is the one that applies to it.
